TERMS AND CONDITIONS OF WIPLASH2000 INTERNET SERVICE 1. Definitions: Subscriber: Is any person who has requested registration or been registered on the Wiplash2000 server. Sponsor: Is any person or organisation that pays for advertisements or otherwise for students to make free use of the wiplash web servers. COMPANY: Is wiplash.com 2. The Subscriber understands that registration to the FREE Internet service is only open to bonafide students who are enrolled at a school, college or other educational instituition. The account will automatically expire once the Subscriber ceases to be a student or the school/college can not or will not confirm to COMPANY that the Subscriber is enrolled as a student. In the event a sponsor is also a subscriber the account of the sponsor will terminate on the expiry of the period of sponsorship. 3. Premium Account (Technical Support Package): The registered Subscriber may request technical support for which the subscriber will be required to pay a fee. Such support shall include advice and assistance on hardware and software configuration of subscriber's computer including setup and provision of web acceleration and other software for optimal performance. 4. Refund Policy: The COMPANY may cease to provide the service to the subscriber or the subscriber may wish to terminate the services from the COMPANY for any reason whatsoever. Any amount paid by the subscriber to COMPANY will be refundable to the subscriber only if the service is terminated by the COMPANY. In the event the company ceases to provide the service any refund will apply for the period commencing on the date of termination to the end of the period of sponsorship. 5. The Subscriber agrees to keep his password confidential and not allow any other person to use his/her account. Should the COMPANY come to know that other persons are using the subscriber's account then COMPANY shall have the right to terminate the Subscriber's account. 6. The Subscriber agrees to participate in any survey conducted by the COMPANY or receive any e-mail messages sent by the COMPANY for the benefit of its sponsors and advertisers. Blocking or refusing to accept these messages or changing the e-mail address without informing COMPANY may result in termination of the account at COMPANY's discretion. 7. Subscriber agrees that The COMPANY shall be free to upgrade and perform maintenance on the Internet service progressively to bring in new features, which may result in temporary disruption of the service. 8. The Subscriber is responsible for payment of relevant telephone charges including any premium rate service charges to the Basic Telephone Service provider. 9. International connectivity to the internet is being provided through a licensed Internet Service Provider and telephone lines by a Licensed Basic Telephone Service provider. Subscriber understands that the limitations on international bandwidth and performance of local telephone lines are beyond the control of the COMPANY. The COMPANY therefore has no liabilities for their performance. 10. The Subscriber is required to fully comply the provisions of the Indian Telegraph Act, 1885, and The Indian Telegraph rules made thereunder and any amendments or replacements made thereto from time to time. 11. The Subscriber is required to ensure that objectionable or obscene messages or communications, which are inconsistent with the established laws of the country, are not made by him or any other person using his password. 12. The COMPANY may revise the fees for technical support and fees for sponsoring a student from time to time at its discretion. 13. The Subscriber assumes total responsibility and risk for use of the Company's Internet Services. Neither The COMPANY nor its affiliates make any express or implied warranties, representations or endorsements whatsoever (including without limitation or endorsements or title or non-infringement, or the implied warranties of merchantability or fitness for a particular purpose) with regard to any merchandise, information or service provided through the Internet, and they shall not be liable for any cost or damage arising either directly or indirectly from any such transaction. it is solely The Subscriber's responsibility to evaluate the accuracy, completeness and usefulness of all opinions, advice, services and other information, and the quality and merchantability of all merchandise; provided through the service or in the Internet generally. 14. The Subscriber understands further that the Internet contains unedited materials, some of which are sexually explicit or may be offensive to some people. The Subscribers access such materials at their own risk. The COMPANY has no control over and accepts no responsibility whatsoever for such materials. 15. The Subscriber is required to desist from putting unsolicited messages on server hosted at The COMPANY premises. The Subscriber is required to ensure that objectionable or obscene messages or communications, which are inconsistent with the established laws of the country, are not made by him or any such person on the web server or web space of the Subscriber. 16. The service is provided on an "AS IS AND AVAILABLE" basis without warranties of any kind either express or implied, including but not limited to warranties of tittle, non-infringement or implied warranties of merchantability of fitness for a particular purpose. No advice or information given by the COMPANY its affiliates or their respective employees shall create a warranty. Neither The COMPANY nor its affiliates warrants that the service will be interrupted or error free or that any information, software or other material accessible on the service is free of viruses, worms, Trojan horses or other harmful components. 17. Under no circumstances shall The COMPANY, its affiliates or its contractors be liable for any direct, indirect, incidental, special, punitive or consequential damages those results in anyway from The Subscribers, use of or inability to use the service or to access the Internet or any part thereof, or The Subscribers reliance on or use of information, services or merchandise provided on or through the service, or that result from mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, or transmission, or any failure of performance. 18. Force Majeure - If at anytime, during continuance of The COMPANY's Internet Services, performance in whole or part or of any obligation under it shall be prevented or delayed by reason of work, hostility, acts of the public enemy,war, civil commotion, sabotage, fire, flood,explosion, epidemic, quarantine restriction, strikes, lockout or act of GOD etc., the Subscriber shall not have any claim for damage against The COMPANY in respect of such non-performance or any delay in performance of The COMPANY's Internet Services. 20. If a Subscriber commits a breach of the above terms and conditions for any reason whatsoever, the COMPANY has the right to disable the Subscriber's account. 21. Arbitration of Disputes - in the event of any question, disputes or differences arising out of provision of The COMPANY Internet Service, the matter shall be referred to the sole arbitration of the Chairman and Managing Director of the COMPANY whose decision shall be final.
